South African Airgun & Deactivated Firearm Compliance

Listings involving airguns, air rifles and certified deactivated firearms require additional compliance review before they may be offered on Collectique.online.

Applicable South African legislation

Firearms Control Act 60 of 2000, as amended.
Firearms Control Regulations, 2004, as amended.

Relevant provisions include the statutory definitions in Section 1, Section 5, applicable offences and restrictions in Section 120, and the deactivation requirements contained in Section 150 of the Firearms Control Act, together with Regulation 105 of the Firearms Control Regulations.

AIRGUNS & AIR RIFLES

Section 1 of the Firearms Control Act contains the statutory definition of an airgun and the criteria used to distinguish qualifying airguns from devices that may fall within the legal definition of a firearm.

Section 5(1)(f) provides that an airgun falling within the statutory definition is not regarded as a firearm for purposes of the Act.

Classification depends on the characteristics of the individual item. Collectique.online therefore requires sufficient information to determine whether an item submitted as an airgun can appropriately be listed in that category.

IMPORTANT: An item will not be treated as an airgun merely because the seller describes it as one. Where classification cannot be established from the information supplied, the listing will be stopped and referred for compliance review.

Section 120 also contains offences relating to the negligent, dangerous or unlawful handling or use of firearms, airguns and certain related devices.

CERTIFIED DEACTIVATED FIREARMS

Section 150 of the Firearms Control Act governs the deactivation of firearms.

For purposes of Section 150, deactivation requires the firearm to be rendered permanently inoperable. The Act requires the prescribed deactivation process to be performed by a gunsmith and provides for certification and notification requirements.

Regulation 105 of the Firearms Control Regulations contains further procedures applicable to the deactivation process, including involvement of the Designated Firearms Officer and prescribed documentation and procedures.

Collectique.online will not classify an item as a Certified Deactivated Firearm merely because it is described as non-firing, disabled or incapable of firing.

A LISTING ON COLLECTIQUE.ONLINE DOES NOT CONSTITUTE A LEGAL TRANSFER OF POSSESSION OR OWNERSHIP.

Where any licence, permit, authorisation, dealer, gunsmith, Designated Firearms Officer, Registrar or Central Firearms Register procedure is legally required, the item must not be transferred contrary to those requirements.

Completing this process does not automatically permit the item to be listed. Every regulated item submission remains PENDING COLLECTIQUE REVIEW until manually approved.
